These Terms and Conditions govern your use of the Lifestyle Of Fitness website, communications, programs, coaching, events, retreats, digital content, and related services provided by The Life of a Fighter Ltd, doing business as Lifestyle Of Fitness (collectively, “LOF,” “we,” “us,” or “our”). By accessing our website, submitting an inquiry, purchasing, or using our services, you agree to these Terms.

1. Eligibility and acceptable use

You must be legally able to enter into a binding agreement. You agree to provide accurate information, use our services lawfully, and not interfere with the website, impersonate another person, misuse content, attempt unauthorized access, or use our services for fraudulent or harmful purposes.

2. Health and fitness disclaimer

LOF provides fitness, wellness, lifestyle, educational, coaching, and experiential services. Our content and services are not medical advice, diagnosis, treatment, emergency care, or a substitute for advice from a qualified healthcare professional. Consult an appropriate healthcare professional before beginning or changing an exercise, nutrition, wellness, or recovery program, especially if you have a medical condition, injury, are pregnant, take medication, or have concerns about your ability to participate. Stop activity and seek appropriate care if you experience pain, dizziness, shortness of breath, or other concerning symptoms. Participation involves inherent risks, and individual results are not guaranteed.

3. Services, purchases, and program terms

Descriptions, availability, pricing, schedules, eligibility requirements, and included features may change. Any checkout page, order form, enrollment agreement, waiver, event policy, cancellation policy, or offer-specific terms presented at purchase or enrollment are incorporated into these Terms. You authorize charges you approve at checkout. Except where a specific written policy or applicable law provides otherwise, fees are governed by the terms shown when you enroll or purchase.

4. Scheduling, cancellations, and third-party platforms

Appointments may be scheduled through Calendly or another scheduling provider. Services may also use Kajabi, HubSpot, Retell AI, payment processors, communications providers, video platforms, and other service providers. Their availability and separate terms may apply. Please follow the cancellation, rescheduling, attendance, and refund terms shown for the particular appointment, event, retreat, coaching program, or purchase.

5. SMS and telephone communications

If you expressly opt in, LOF may send you recurring or non-recurring text messages and place calls about your inquiry, requested follow-up, appointment scheduling and reminders, customer care, programs, events, or offers consistent with your consent. Message frequency varies. Message and data rates may apply. Consent to marketing texts is not a condition of purchase. You may opt out of text messages at any time by replying STOP. Reply HELP for help or contact us using the information below. We may send a final confirmation after an opt-out request. Carriers are not liable for delayed or undelivered messages. Your SMS consent and mobile information will not be sold or shared with third parties or affiliates for their own marketing or promotional purposes. Operational service providers may process communications solely to provide services for LOF.

By providing a phone number, you represent that you are the subscriber or customary user of that number and will notify us if it changes. Calls may be placed using automated technology or an AI-assisted agent where permitted by law. We honor applicable consent, do-not-call, opt-out, and quiet-hours requirements.

6. Intellectual property

The LOF name, branding, website, videos, program materials, training materials, downloads, photographs, graphics, and other content are owned by or licensed to LOF and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable license to use purchased or provided materials for your own lawful personal use. You may not reproduce, sell, distribute, publicly display, create derivative works from, or commercially exploit them without written permission.

7. User submissions

You are responsible for information and content you submit. You grant LOF permission to use submissions as reasonably necessary to respond to you and provide requested services. We will not use a testimonial, likeness, or personal story for public promotion without any consent required by law.

8. Privacy

Our collection and use of personal information are described in our Privacy Policy. By using the website or services, you acknowledge that policy.

9. Disclaimers and limitation of liability

To the fullest extent permitted by law, the website, content, and services are provided “as is” and “as available.” LOF does not warrant uninterrupted access, error-free operation, or particular health, fitness, business, or financial results. To the fullest extent permitted by law, LOF and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the website or services. Nothing in these Terms excludes liability that cannot legally be excluded.

10. Indemnification

To the extent permitted by law, you agree to indemnify and hold LOF harmless from third-party claims arising from your unlawful misuse of the website or services, violation of these Terms, or infringement of another person’s rights.

11. Changes and termination

We may update these Terms by posting a revised version and effective date. Material changes will apply prospectively as required by law. We may suspend or terminate access for unlawful, unsafe, abusive, or materially noncompliant conduct.

12. Governing law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
